Marijuana class action suit filed

     On August 3, 1998, Lawrence Elliott Hirsch filed a class action in the United States District Court in Philadelphia, Pennsylvania, seeking an end to the government’s ban on medical marijuana.

     The suit, filed on behalf of 165 medical marijuana patients across the United States, hopes to stop the federal government’s war against the sick and dying; obtain a judicial declaration that the government’s prohibition of therapeutic cannabis is unconstitutional and discriminatory; obtain a judicial decree that the government must make marijuana available to all with a medical need; and recognize the basic freedoms regarding the farming, processing and distribution of cannabis.

     In a class action, one or more members of a "class," medical marijuana users in this case, may sue as representative parties on behalf of all members. Class actions were created so average citizens could take on even the largest organizations such as the federal government with their seemingly endless supply of cash.

     This class action seeks no financial restitution.
